Arguments in gender equity lawsuit set for Thursday

Legal battle to switch seasons began in 1998

      DETROIT (AP) - The 6th U.S. Circuit Court of Appeals in Cincinnati is scheduled to hear oral arguments Tuesday in a case involving the Michigan High School Athletic Association's sports schedules.
      The legal battle that has stretched nearly eight years involves switching seasons for some boys and girls sports. Grand Rapids-based Communities for Equity sued the MHSAA in June 1998, alleging Michigan high schools discriminated against female athletes by scheduling their basketball, volleyball and other sports seasons during nontraditional times of the year.
      Communities for Equity won at the district court level in December 2001. The MHSAA appealed U.S. District Judge Richard Alan Enslen's decision, but the appeal was denied by the 6th Circuit. The MHSAA appealed to the U.S. Supreme Court, which told the appeals court to reconsider the case.
      The same three-judge panel that heard the MHSAA's original appeal in 2004 was to again listen to arguments by both parties. A decision is not expected for several months, The Detroit News reported Sunday.
