January 21, 2006Judge will consider allowing evidenceBEULAH - A judge will consider overturning a ruling that barred evidence crucial to the state's attempt to charge Mark Unger with first-degree murder.Circuit Court Judge James Batzer heard hours of testimony Friday from Oakland County Medical Examiner Dr. L. J. Dragovic. He continued the hearing until Feb. 17 to give attorneys time to prepare arguments. At issue is whether Dragovic's conclusion that Unger's wife drowned after she suffered a head injury can be backed up with accepted scientific theory. The pathologist who performed the autopsy in the case determined the 37-year-old died of a head injury. Prosecutors from the state Attorney General's office contend Florence Unger was moved into the water after she fell or was pushed from atop a boathouse at a resort on Lower Herring Lake in October 2003. Attorneys for Unger maintain their client's innocence. During hearings, the attorneys have implied that Florence Unger could have fallen from the boathouse and wound up in the lake after she suffered a seizure. Prosecutors have asked Batzer to overturn a ruling by District Court Judge Brent Danielson that barred Dragovic's testimony.
