A local contractor has sued the developers of Brewery Creek, a mostly vacant project along M-22 in Greilickville.

Elmer's sues for construction money

Contractor says it's owed almost $217,000

      TRAVERSE CITY - A local contractor sued developers of the mostly-vacant Brewery Creek project along M-22 in Elmwood Township to foreclose on a construction lien that tops $200,000.
      Elmer's Crane & Dozer Inc. of Traverse City sued Brewery Creek Development LLC of Howell and a group of other individuals and financiers in the Greilickville project, alleging the contractor hasn't been paid for almost $217,000 in work done at the site two years ago.
      A construction lien against the property filed by Elmer's this week with the Leelanau County Register of Deeds office stated the company did $866,780 worth of work between April 2003 and October 2004. But it was paid only $650,034, leaving an unpaid balance of $216,746.
      The town-center style project was started three years ago by Ted Lockwood of RE/MAX Bayshore Properties real estate office in Greilickville and Devereaux Trepp of Bay Resource Management Inc. in Elmwood, also named in the suit. Other partners were George and John Cook of Brighton. George Cook currently is listed as the resident agent for Brewery Creek LLC, according to the state Bureau of Commercial Services.
      Lockwood refused to comment on the suit when contacted Friday, while Trepp and George Cook did not respond to requests for comment.
      The development, which includes a 300-foot-plus wooden boardwalk along Brewery Creek, nautical-style light fixtures plus road and curb infrastructure, remains largely vacant. The 16-acre property has 13 development sites totaling almost 61,000 square feet of commercial and retail space at the former site of the Classic Building Supply lumber yard.
      A restaurant opened there in 2004 but closed within months. A local chiropractor office is moving into the former restaurant building and a new Subway outlet also will open there this year, Lockwood said this month.
      The Korner Gem jewelry store is also located in the project.
