Prosecutor Alan Schneider recommends what he believes is an appropriate sentence for former East Bay Township clerk Janice Gee, while defense attorney James Hunt and Gee listen during her sentencing hearing in a packed Grand Traverse courtroom.
TRAVERSE CITY - It's 11 months in the county jail for former East Bay Township Clerk Janice Gee, convicted last month of stealing $62,000 in public funds.
Thirteenth Circuit Court Judge Philip Rodgers on Friday imposed the maximum sentence allowed under pre-sentencing guidelines for nine felony embezzlement counts on which jurors convicted Gee last month.
"For many years, when you did payroll every two weeks you committed an intentional wrongful act that benefited you," Rodgers told Gee. "It appeared to be simple, unvarnished greed."
Gee, 60, also was ordered to forfeit her retirement pension and deferred compensation accounts to East Bay, a charge of $120,000 to cover lost funds, auditing and legal costs.
"I express my remorse for what I have done," Gee told Rodgers. "I would like to apologize to the citizens of East Bay, my friends and my family."
"This wasn't an accident?" Rodgers asked Gee about her earlier contention that money disappeared because of a software error. "You are willing to finally admit that?"
After a moment, Gee quietly responded, "Yes."
Rodgers told Gee, who faced a maximum of five years in prison, that he considered sending her to prison but was satisfied justice had been served with the restitution order.
Rodgers also ordered Gee to serve five years probation, not hold any jobs handling money, and warned her he would not approve any early release on her sentence.
