December 22, 2005Firefighter's fate is delayed againTRAVERSE CITY - The fate of a Grand Traverse firefighter charged in the traffic deaths of a woman and her son is delayed again, this time to allow a district judge to rule if there's enough evidence to proceed to trial.Cory Carlton, 26, must wait until next month to hear whether 86th District Court Judge Thomas Phillips will bind him over in the deaths of Rebecca Garrisi, 28, and her 11-month-old son, Jesse. Carlton was driving a Grand Traverse fire truck March 8 when he drove through a Garfield Township stoplight and struck a vehicle driven by Garrisi's husband, Matthew. Carlton's preliminary hearing ended Wednesday, but Phillips said he needs time to consider the evidence before ruling. Antrim County's Charles Koop, appointed special prosecutor, filed negligent homicide charges against Carlton in August. Koop told the court Wednesday he also wants an additional charge of involuntary manslaughter added. "Going through a red light at 30 to 35 mph is disregard," he said. "There is no indication he used any caution or due regard." The Michigan vehicle code allows emergency vehicles to proceed past a red light "only after slowing down as may be necessary for safe operation."
