April 8, 2004ACCIDENT REPORT: Woman had pot in systemShe will be arraigned on 4 felony countsByRecord-Eagle staff writer TRAVERSE CITY - A Traverse City woman faces felony charges after authorities said a toxicology report showed she had marijuana in her system at the time of a fatal crash. Delores Marie Derror, 40, allegedly admitted she smoked a marijuana cigarette four hours before a January accident on M-72 that killed a woman and seriously injured seven others, including four children. Grand Traverse County Chief Assistant Prosecutor Alan Schneider said officials waited for the results of a blood test to determine charges. Derror is expected to surrender to police sometime this week. She will be arraigned on four felony charges and one misdemeanor that carry combined terms of up to 41 years. Under a law that took effect Oct. 1, it may not matter whether she was under the drug's influence at the time of the accident, only that the test came back positive for marijuana use. Schneider would not say whether the amount of the chemical found in her system could prove influence. "I'm not going to discuss those issues publicly until we're in court," he added. Under the new law, drivers could be presumed to be under the influence of marijuana if they test positive for the drug. The new marijuana law was part of the same legislation that lowered the threshold for drunken driving in Michigan from 0.10 to 0.08. Angela Grierson, 28, of Mancelona, died in the Whitewater Township crash. Seven others, including four children and Derror, suffered serious injuries. Grierson was the girlfriend of Randy Elkins of Lake Ann, whose four daughters - Eden, Brittany, Notasha and Tegan Elkins - were injured.
